Terms of Service

These Terms of Service (“Terms”) govern your use of Cadence (“Cadence”, “we”, “us”) and the application available at app.cadencecreator.com (the “Service”). By creating an account or using the Service, you agree to these Terms.

Eligibility

You must be at least 18 years old and able to enter into a binding contract to use Cadence.

Your account

You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. Notify us promptly of any unauthorized use.

Subscription and billing

Cadence is offered as a paid subscription. Current pricing is shown before checkout. New subscriptions may include a 14-day free trial. If you start a trial and do not cancel before the trial ends, your selected plan will automatically renew and your payment method will be charged through Stripe.

Prices are listed in Canadian dollars unless stated otherwise. Applicable taxes may be added at checkout or on renewal. Stripe may collect billing address and tax information to calculate taxes and process payments.

You can manage or cancel your subscription through the Stripe billing portal inside Cadence. Cancellation stops future renewals. Your access continues until the end of the current billing period. Fees are non-refundable except where required by law.

Acceptable use

You agree not to:

  • Use the Service for any unlawful purpose.
  • Reverse engineer, scrape or interfere with the Service.
  • Upload content that infringes third-party rights or contains malware.
  • Attempt to access another customer's account or data.
  • Misrepresent your identity, payment information or authority to use an account.

Your data

You retain ownership of the records you enter into Cadence. You grant us a limited licence to host and process that data only as needed to provide, secure, improve and support the Service. See our Privacy Policy for more.

Your records and responsibility

You are responsible for the accuracy, completeness and legality of the records, amounts, classifications, attachments, notes, GST/HST status, gifted-product values and other information you enter into Cadence. Cadence may generate summaries, estimates, prompts and exports based on your records, but we do not independently verify those records.

No tax or legal advice

Cadence helps you organize your records and surface items that may need review. Cadence is not a tax filing service and does not provide tax, legal or accounting advice. Always confirm with your accountant or qualified professional.

Service changes and availability

Cadence is an early-stage product and may change over time. We may add, modify, limit, suspend or discontinue parts of the Service at any time. We work to keep Cadence available but do not guarantee uninterrupted service.

Disclaimers

The Service is provided on an “as is” and “as available” basis without warranties of any kind, whether express or implied, to the maximum extent permitted by law.

Limitation of liability

To the maximum extent permitted by law, Cadence's total liability arising out of or related to the Service is limited to the amounts you paid to Cadence in the twelve months preceding the claim.

Termination

You may stop using the Service at any time. We may suspend or terminate accounts that breach these Terms. After cancellation or termination, your records may remain available for export for up to 30 days, unless a longer period is required for billing, legal, security, backup, fraud-prevention or dispute-resolution purposes. After that period, data may be deleted in accordance with our retention policy.

Governing law

These Terms are governed by the laws of the Province of Ontario, Canada and applicable federal laws of Canada, without regard to conflict-of-laws principles.
