These Terms of Service (“Terms”) govern your use of Cadence (“Cadence”, “we”, “us”) and the application available at app.cadencecreator.com (the “Service”). By creating an account or using the Service, you agree to these Terms.
Eligibility
You must be at least 18 years old and able to enter into a binding contract to use Cadence.
Your account
You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. Notify us promptly of any unauthorized use.
Subscription and billing
Cadence is offered as a paid subscription, with a free trial period. Subscriptions renew automatically until cancelled. You can cancel at any time from inside the Service; access continues through the end of the current billing period. All fees are processed by Stripe.
Acceptable use
You agree not to:
- Use the Service for any unlawful purpose.
- Reverse engineer, scrape or interfere with the Service.
- Upload content that infringes third-party rights or contains malware.
- Attempt to access another customer's account or data.
Your data
You retain ownership of the records you enter into Cadence. You grant us a limited licence to host and process that data only as needed to provide the Service. See our Privacy Policy for more.
No tax or legal advice
Cadence helps you organize your records and surface items that may need review. Cadence is not a tax filing service and does not provide tax, legal or accounting advice. Always confirm with your accountant or qualified professional.
Service changes and availability
We may modify, suspend or discontinue parts of the Service at any time. We work to keep Cadence available but do not guarantee uninterrupted service.
Disclaimers
The Service is provided on an “as is” and “as available” basis without warranties of any kind, whether express or implied, to the maximum extent permitted by law.
Limitation of liability
To the maximum extent permitted by law, Cadence's total liability arising out of or related to the Service is limited to the amounts you paid to Cadence in the twelve months preceding the claim.
Termination
You may stop using the Service at any time. We may suspend or terminate accounts that breach these Terms. Upon termination, you can export your records for a reasonable period, after which data may be deleted in accordance with our retention policy.
Governing law
These Terms are governed by the laws of the Province of Ontario, Canada and applicable federal laws of Canada, without regard to conflict-of-laws principles.
